Disposition Authorities for Individual Classifications for Headquarters Case Files. Part B: Classification 173. Civil Rights Act of 1964.

The FBI established this classification in 1964 for investigations of violations of the Civil Rights Act of 1964 especially in the areas of public accommodations, public facilities, public education and employment. In 1972 Congress amended that act to prohibit discrimination on the basis of sex in public educational instututions. Investigations in the classification relate only to the 1964 act while other civil rights cases are in classifications 44 and 157. The Bureau in general only conducted preliminary and often perfunctory investigations upon the receipt of citizens' complaints. Thorough investigations were only undertaken at the request of the Civil Rights division of the Department of Justice. The Civil Rights Division of Justice gave the Bureau detailed instructions for investigatory procedures that require forwarding the results to the Justice Department. At times the division and the Bureau sharply differed on policy, such as in interpreting the law on discrimination in employment.

The FBI established this classification when it assumed responsibility for ascertaining the protection capabilities and weaknesses of defense plants. Each plant survey was a separate case file, with the survey, supplemental surveys, and all communications dealing with a plant insofar as plant protection was concerned, filed together.
